A Guide To Licensable Activities

The Licensing Act 2003 outlines four recognised Licensable Activities. Here’s a guide of what those Licensable Activities include and the rules they have to abide by.

The Retail Sale Of Alcohol

This is where the alcohol is served to any person for consumption either on or off the premises. The premises license must show whether the venue is authorised for On site consumption, Off site consumption or Authorised for Both On and Off site consumption.

Any premises where retail sales of alcohol take place must have a Designated Premises Supervisor (DPS). The DPS must have a Personal License

The Supply Of Alcohol in Clubs

Where venues hold a Club Premises Certificate, the supply of Alcohol takes place. No sale takes place as the club members already own the alcohol.

In order to be granted a Club premises Certificate the following criteria must be met:

• Not operating for a profit
• Member criteria for club members
• Club Rules

Some examples of Club Premises are:

• Working Men’s Clubs
• Sports Clubs
• Social Clubs
• Some British Legion Clubs.

As alcohol sales do not actually take place, there is no requirement for anyone to have a Personal License and therefore no DPS is needed.

Regulated Entertainment

Regulated entertainment means providing certain entertainment for audiences or spectators with the intention of making a profit.

Below are a few examples of regulated entertainment:

• Exhibition of a film
• Performance of a play where the audience is more than 500 people and the performance takes place at any time between 11PM and 8AM
• Boxing of Wrestling for entertainment, whether its indoor or outdoor, this also includes any combined Mixed Martial Arts.
• Indoor Sporting Events where the audience is larger than 100 people and the performance takes place between 11PM and 8AM.
• Live music performace

Late Night Refreshment

Late night Refreshment refers to the sale of hot food or drink between the hours of 11PM and 5AM, any sales between those hours of hot food or drink will be a licensable activity and the Local Authorities will have the power to regulate it:

Examples include:

• Take away’s
• Kerb side Burger Vans
• Kebab Shops
• Some restaurants
